1. Acceptance of Terms
   By accessing or using this website, engaging with our services, or participating in any communication with Kreative Imaginings, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any part of these Terms, please do not access or use our website or services.
   These Terms apply to all offerings under Kreative Imaginings, including but not limited to consulting, training and development programs, certifications, digital content, memberships, workshops, and downloadable materials.
2. Scope of Services
   Kreative Imaginings provides organizational strategy, leadership development, talent engagement, training programs, certification pathways, and consulting services to adjusting firms, individual adjusters, and insurance carriers. Our services may include:
   Consulting, coaching, and strategic planning
   Digital and in-person training, certification programs
   Memberships, online courses, downloadable materials
   Workshops, speaking engagements
   Cross-industry talent development and field operations frameworks
   We reserve the right to modify, expand or discontinue any service at any time without prior notice. Individual agreements will define the specific deliverables and scope for each engagement.
3. Intellectual Property Rights
   All content, frameworks, curricula, training materials, visuals, written copy, logos, websites, and deliverables created by Kreative Imaginings remain our exclusive intellectual property. Clients are granted a limited, non-exclusive, non-transferable license to use deliverables for their intended business purpose only. Any reproduction, distribution, modification, resale or public dissemination of materials without prior written consent is prohibited.
4. Confidentiality & Data Handling
   Each party agrees to keep confidential all proprietary or non-public information received in connection with any project. We handle personal and corporate data in compliance with applicable U.S. and international privacy laws, including relevant provisions of the CCPA and GDPR. Corporate clients agree to ensure their employees and representatives comply with equivalent confidentiality standards.
5. Corporate / B2B Client Engagements
   For business-to-business (B2B) services, a separate Statement of Work (SOW) or Service Agreement may be executed to define project terms, scope, deliverables, timelines, and fees. These Terms apply in conjunction with any signed agreement; in the event of conflict, the executed agreement governs.
6. Fees, Billing & Payment Terms
   Fees for services are specified in the Proposal, SOW or invoice. Unless otherwise stated, payment is due within thirty (30) days of invoice date. We reserve the right to change pricing or payment structures at any time, though changes will not apply retroactively to already-executed agreements. Failure to make timely payment may result in suspension or termination of services and deliverables.
7. Refunds & Cancellations
   All sales are final unless explicitly stated otherwise in writing. Refunds are granted at the discretion of Kreative Imaginings under these frameworks:
   Consulting & Coaching Services: Non-refundable after sessions or project work have commenced.
   Corporate Retainers: May be cancelled as defined in your contract; partial refunds may be subject to administrative deductions.
   Digital Products, Online Courses, Memberships: Non-refundable once accessed, downloaded, or delivered.
   Workshops or Events: Tickets or enrollments may be transferable but are non-refundable unless the event is cancelled by Kreative Imaginings.
8. Limitation of Liability
   To the maximum extent permitted by law, neither Kreative Imaginings nor its affiliates, officers, or personnel shall be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, business interruption or data loss, arising out of or in connection with these Terms or any services provided. In no event shall our total aggregate liability exceed the fees paid by you for the specific service giving rise to the claim.
9. Professional & Results Disclaimer
   Our services, content and materials are provided for educational and informational purposes only. While our frameworks are based on industry experience and field expertise, we make no guarantees regarding outcomes. Success depends on client implementation, market conditions, and external factors beyond our control. Nothing on our website or in materials constitutes legal, financial, medical or insurance advice.
10. Future Services Clause
    These Terms govern all current and future offerings including programs, publications, online content, products or media initiatives not yet released. Your use of or access to any future service constitutes acceptance of the latest version of these Terms.
11. Dispute Resolution
    Any dispute arising under or related to these Terms, or any services provided by Kreative Imaginings, shall be resolved by binding arbitration or mediation in the State of New York. Both parties waive their right to trial by jury. If a court proceeding is required, the exclusive venue shall be state or federal courts located in New York County, NY.
12. Governing Law
    These Terms are governed by and interpreted under the laws of the State of New York, without regard to its conflict of laws rules.
13. Modifications
    We may periodically update these Terms. All changes will be posted to our website with a revised effective date. Your continued use of our services or site after changes constitute acceptance of the new Terms.
